Rider Terms
Version 1.1 · Effective 4 October 2026
These Rider Terms apply when you book a vehicle on Hire N Ride. They are in addition to the Terms of Use, the Fee Policy and the Privacy Policy. A Booking Agreement is the lease between the Host and the Rider for one trip. It is the booking cover page together with the Rider Terms, the Fee Policy, and the Vehicle Handover & Delivery Policy. Hire N Ride is not a party to it. No signature is needed. The Terms of Use and the Privacy Policy are a separate agreement between you and Hire N Ride.
1. Who you rent from
The vehicle is owned and leased to you by an independent Host, not by Hire N Ride. Hire N Ride runs the Platform, verifies users, collects payments as the Host's agent and helps resolve problems.
The Host promises you that, for the whole booking, the vehicle is roadworthy, its registration certificate, insurance, pollution certificate and any permit required for the booking are valid, and, for a two-wheeler, the helmets provided are in good condition.
2. Eligibility
| Two-wheelers | Four-wheelers | |
|---|---|---|
| Minimum age | 18 years | 21 years |
| Licence held for at least | 6 months | 1 year |
| Licence class | MCWG for geared motorcycles; MCWOG (or MCWG) for gearless scooters | LMV (non-transport) |
| Other | Valid ID; selfie/liveness check | Valid ID; selfie/liveness check |
International visitors need a valid International Driving Permit together with their home licence, plus their passport and visa.
Hire N Ride may set higher age or licence limits for some vehicles. They are shown on the listing.
3. KYC and verification
3.1 You must complete KYC: your driving licence (verified against the Parivahan/Sarathi records), an ID document (masked or offline-verified Aadhaar, passport, or another listed ID), and a selfie.
3.2 Only the verified Rider may drive or ride. An additional driver must be added and verified in the app before the trip.
3.3 Carry your original licence during the trip, and show it to the Host at pickup.
4. Before the trip
4.1 Read the Booking Agreement in the app and accept it by ticking the unticked checkbox and tapping "I Agree", and, if the app asks, by confirming with a one-time password sent to your registered mobile. This acceptance forms a binding contract under the Indian Contract Act, 1872. It is not unenforceable merely because it was made in electronic form (Information Technology Act, 2000, section 10A). No signature is needed. The trip cannot start until both you and the Host have accepted it. A PDF copy is emailed to you.
4.2 Complete the handover checklist with the Host: timestamped photos/video, odometer and fuel. Point out any existing damage. What is recorded here will be used if there is a dispute.
5. Safety rules (two-wheelers)
(a) Helmets are compulsory for the rider and the pillion (Motor Vehicles Act, section 129). One ISI-marked helmet is provided. If you carry a pillion, you need a second helmet (book it as an add-on or bring your own). (b) No more than one pillion. (c) Hill riding: ride in daylight wherever possible, use lower gears on descents, check the weather, and allow extra time. (d) You confirm in the app that you will follow these rules.
6. Prohibited use
You must not:
- drive under the influence of alcohol or drugs;
- let any unverified person drive;
- use the vehicle for hire or reward, ride-hailing, deliveries or carrying goods for payment;
- race, perform stunts, tow, or go off-road (unless the listing allows it);
- carry more people or more load than the vehicle is permitted to carry;
- take the vehicle outside the Permitted Territory shown on the booking (including across a state border, unless the listing allows it);
- use the vehicle for anything illegal;
- tamper with the odometer, GPS or any tracking device; or
- sublet the vehicle.
7. Fines and challans
| Type | Who pays |
|---|---|
| Driving Fines during your trip: speeding, signal, helmet/seat-belt, parking, tolls, FASTag shortfalls, etc. | You |
| Vehicle Compliance Fines: the vehicle's registration category, permit, plates, documents, insurance, PUC or fitness | The Host, not you |
If a challan from your trip arrives after you return the vehicle, the Host may claim it through the Platform within 90 days of the trip ending, with the challan as evidence. You will be shown the claim and can dispute it before it is deducted or charged.
If the vehicle is seized during your trip for a vehicle-compliance reason that is not your fault, you will receive a refund of the unused rental, and the Host bears the costs.
8. Damage
8.1 You must return the vehicle in the same condition, apart from fair wear and tear.
8.2 For accidental damage during the booking, your liability to the Host is limited to the security deposit shown on the booking. That limit does not cover intoxication, riding without a valid licence, prohibited use, or theft caused by leaving the vehicle unsecured. Those cases, and any dispute about a deduction, are decided through the claims process in the Fee Policy.
8.3 You are responsible for the full loss where the damage or loss results from:
- prohibited use (Section 6);
- driving under the influence;
- having no licence, or the wrong licence class;
- driving by an unverified person;
- riding without a helmet (two-wheelers);
- a deliberate act or gross negligence;
- failing to report the incident as required, where that harms an insurance claim;
- leaving the vehicle unlocked or the keys in it; or
- use outside the Permitted Territory.
8.4 Damage claims must be raised by the Host within 24 hours of return, with evidence. You will be shown the evidence and can dispute it.
9. Accidents, breakdowns and theft
Stop safely, help anyone injured and call 112 if needed. Report the incident in the app within 2 hours, where it is safe to do so, and never later than 24 hours. For theft or injury, file a police report (FIR). Do not arrange repairs without the Host's approval through the app, except for minor emergency repairs needed for safety.
10. Return
Return the vehicle at the agreed time and place, with the agreed fuel level. Late return fees and kilometre/fuel charges are in the Fee Policy. If the vehicle is not returned within 6 hours of the end time and you cannot be reached, the Host and Hire N Ride may treat it as unauthorised retention, and use lawful means only (including GPS location and a police complaint) to recover it.
11. Deposit and refunds
The security deposit, how it can be used and refund timelines are set out in the Fee Policy. In short: if there is no claim, the refund is initiated within 24 hours of return, and money usually reaches you in 3–4 business days (two-wheelers) or 5–7 business days (four-wheelers), depending on your bank.
12. Liability
Hire N Ride's total liability to you for a booking is limited to the amount you paid for that booking, except where the law does not allow a cap. Your rights as a consumer are not affected (Terms of Use, Section 10).
13. Complaints
Use Help > Raise a complaint in the app, or the grievance contact published at https://www.hirenride.com/legal (Terms of Use, Section 17). We acknowledge complaints within 24 hours and aim to resolve them within 15 days, and within one month at the latest.
14. Disputes with the Host
A dispute between you and the Host goes first through Hire N Ride's complaint process. If it is not resolved there, the courts at your location decide it, and if you are a consumer, so does the consumer commission at your location. The arbitration clause in the Terms of Use does not apply to a dispute that is only between you and the Host.
